Tambah baik skim pembantu tadbir awam

KUALA LUMPUR 2 Mei – Kesatuan Pembantu Tadbir dan Pembantu Tadbir Rendah (Pendidikan) Semenanjung Malaysia (Keptan) mahu Jabatan Perkhidmatan Awam (JPA) mengkaji semula skim perkhidmatan di bawah Gred N, W dan S yang dilihat tidak memberi manfaat kepada kira-kira 100,000 pembantu tadbir.

Presidennya, Che Saad Hashim berkata, pihaknya akan memperjuangkan nasib dan hak ahlinya melalui serahan kertas cadangan yang mengandu­ngi saranan mele­takkan nilai tambah dalam Pekeliling Skim Perkhidmatan Bil. 1/2016.

“Saya melihat JPA seolah-olah meminggirkan bidang pembantu tadbir ketika me­laksanakan pro­ses penambahbaikan skim perkhid­matan bulan lalu menyebabkan kebanyakan kakita­ngan mula mengeluh terutamanya Gred N yang tidak disentuh langsung.

“Kami tidak menentang tetapi lebih kepada mengharapkan JPA sebagai sebuah institusi yang boleh mengubah nasib kira-kira 100,000 kakitangan pembantu tadbir sedia ada,” katanya dalam sidang akhbar penggubalan se­mula skim per­khidmatan di bawah Gred N, W dan S, di sini hari ini.

Yang turut hadir, 10 pre­siden pertubuhan bukan kerajaan (NGO) yang bersama-sama memperjuangkan hak ahli ma­sing-masing dengan membuat perbincangan penggubalan kertas cadangan penambahbaikan Skim Perkhidmatan PT (P/O), W dan S bagi sesi kedua.

Antara NGO yang turut serta termasuk Gabungan Kesatuan Perkhidmatan Kerani dan Bersekutu Kerajaan (AUEGCAS), Kesatuan Pembantu Tadbir Kementerian Kesihatan (Keptakes), Kesatuan Kakitangan Am Universiti Sains Malaysia (KKAUSM), Kesatuan Kakitangan Umum UiTM (KKUUiTM) dan Kesatuan Kakitangan Am Universiti Malaya (KKAUM).

Empat lagi NGO terlibat ialah Kesatuan Pegawai-Pegawai Mara (Kekam Mara), Kesatuan Staf Pelaksana Universiti Malaysia Kelantan (Kespumk), Kesatuan Kakita­ngan Perkhidatan Tadbir dan Awam Pasukan Polis Semenanjung Malaysia (Pacsu), Kesatuan Pekerja-Pekerja Awam Angkatan Tentera Malaysia (Kesatria) dan Ke­satuan Kakitangan Universiti Utara Malaysia (Keswa).

Terdahulu, JPA telah menyempurnakan proses penambahbaikan 252 skim perkhid­matan sedia ada di bawah langkah rasionalisasi Skim Perkhidmatan Bagi Perkhidmatan Awam Persekutuan dan telah dimuat naik ke laman sesawang JPA pada 14 April lalu.

Tambah Che Saad, antara tiga intipati yang akan disenaraikan dalam kertas cadangan kepada JPA adalah pindaan gred, pindaan nama serta cadangan mewujudkan gred baharu khas untuk pe­nyandang (KUP) jawatan tertentu.

Sementara itu, Ketua Pengarah Perkhidmatan Awam, Tan Sri Mohamad Zabidi Zainal ketika dihubungi berkata, pihaknya te­lah dimaklumkan tentang kertas cadangan daripada Keptan ketika membuat perjumpaan dengan kesatuan itu pada 13 April lalu.

“Namun sehingga kini saya belum menerima kertas cada­ngan tersebut tetapi saya akan mengkaji kesemua cadangan yang dikemukakan sebaik sahaja menerimanya daripada Keptan dan 10 NGO lain,” katanya.

Found guilty of union busting

KUALA LUMPUR: An electronics company has been found guilty of union busting by the Industrial Court.

Court chairman Datuk Mary Shakila G. Azariah said Renesas Semiconductor KL Sdn Bhd had violated the Industrial Relations Act by its actions against members of the Electro­nics Industry Employees Union Western Region Peninsular Malaysia in its employ.

She said employers were lawfully bound to respect a worker’s right to engage in unionism and also they can participate in the lawful activities of a union.

She added that employers were also ethically and morally constrained from interfering with the affairs of a trade union and the right of workers to organise, discriminate, restrain, or coerce against any worker because of legitimate trade union activities and abuse authority in any form.

Mary Shakila said this in the complaint of union busting brought by the union against Renesas for breaching Sections 4(1), 4(3), and 5(1)(d)(i) and (ii) of the Act.

The western region union was registered on Dec 1, 2009, seven months after the Government approved the unionisation of the workers in the electronics industry into four regions. Previously, there were only in-house unions in the electronics sector.

In her 49-page award dated March 8, Mary Shakila said a Renesas employee, Wan Noorulazhar Mohd Hanafiah, was elected as pro-tem president of the union but he was told by the plant director that he “was not to promote the establishment of a national/regional wide union for the electronics industry” as the company would be forming an in-house union.

The union submitted a claim for recognition from Renesas on Jan 18, 2010 but the company refused to grant it.

A month later, the company organised a seminar on the setting up of an in-house union which was attended by members of the Joint Consultative Committee (JCC) in the company at Cyberview Resort & Spa.

Mary Shakila noted that the timing of the seminar left “a lot to be said” as to the motives of Renesas.

Wan Noorulazhar alleged he was offered the role of president in the proposed in-house union, which he declined, resulting in him being made to perform tasks below his job grade and being monitored by the Human Resources Department via CCTV.

He was later dismissed in 2011 after a domestic inquiry found him guilty of misconduct for allegedly maligning Renesas Semiconductor publicly on his Facebook page. Wan Noorulazhar is challenging his dismissal in the Industrial Court.

While Mary Shakila refrained from passing comment on his case, she noted that his termination was “manifestly a union-busting tactic”.

In evaluating the evidence, she said that the company’s witnesses, all still serving in the employ of the company, “are not to be believed.”

“The court is satisfied with the veracity of the union’s witnesses and their evidence, some of whom are still employed by the company and have risked their jobs to testify against the company.”
